Abstract

This study delves into the analytical examination of familial rights within the framework of Shari'ah (Islamic law), focusing on their significance and implications. Shari'ah, as a comprehensive legal and ethical system, encompasses a broad range of principles governing familial relationships, including marriage, inheritance, and the treatment of spouses and children. This paper investigates the importance of these rights by exploring classical and contemporary interpretations of Shari'ah, examining how they address issues of equity, justice, and societal harmony. By analysing historical texts, legal precedents, and modern applications, the study highlights the evolving understanding of familial rights and their impact on both individual and societal levels. The findings underscore the centrality of these rights in ensuring a balanced and just approach to family life, while also addressing contemporary challenges and adaptations within the legal framework. This analytical approach aims to provide a deeper understanding of Shari'ah’s role in promoting ethical familial relationships and its relevance in modern contexts.
